No. You got me wrong. I have friends filing through consulting firms. You got me wrong completly. Outsourcing/offshoring firms are completely different from Consulting firms. Consulting firms files new h1s and get the people here to work for their clients. This is good to new prople who wants to come here legally, to US busincsses and to everybody (except for anti-immigrants). But Outsourcing/offshoring firms file lot of H1s and do not use them. Thats the problem. If they use, it is not going to be a problem.

I am not agaist the consulting or competition or anybody who wants to work here legally. I am againt the wastage of H1s. Applying them and not using them is a problem. By the way, where was the law to excempt those so called outsourcing firms from numerical H1 cap? Can you please provide the link? If there is one, then there is no chance of reaching cap so fast. My wife is in India for the last year to get new H1-B (6 years completed)
She has a valid dependant visa till May 2008
Based on new rule, she applied to reclaim 3 years of H4 for H1-B.
H1-B is approved, she is going to Chennai, India for stamping.
If for some reason H1 is denied, can she come back as dependant?

Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

When USCIS sent you the RFE notice, you would have seen "Request for Evidence". After USCIS receives your response, you would have seen the hard LUD, while the header is still for RFE. Then after some days (with in 60 days), the header changes to "Request for Evidence Response Review", while the old header "Request for Evidence" vanishes. I was in the same boat like you. I spoke to my attorney's team and they offered me the insight glimpse of working of USCIS.

I just don't understand why people who suffer so much from the whole waiting would not contribute. If one day, IV core members decide to close this organization and go on with their lives, I would like to know how those people who have not contributed feel.
The economic theory, "inferior purge the good" works here. Without sufficient "good" individual, we will eventually be out of this game! So to those who have not contributed yet, do you want to see the disorganization of IV? Do you want to become a group for which no one would speak up for you? Do you want to wait desperately and endlessly for your GCs? Do you want to continue to work like a slave and feel worried about travelling outside US?... If not, please contribute!!!

If you are saying that EB3 would move from 2001 to 2004 this year, then that is what BharatPremi and I were saying. We should be OK with 3 years movement for EB3.
And, guys don't jump on me, if we accept that 3-4 years for GC is acceptable (though I agree that GC in 6 months would be the vision, dream...), then guys who have filed in 2004 should be patient till 2008 and guys who filed in 2006 should wait till 2010.
The only guys who should worry is those with PDs 2001 and 2002. Again, most of them got cleared in Jun, July this year except those who are stuck in name check and LC in BEC.
Well, I was saying "at least". So if goes for 2 years to clear pre-PERM backlogs, I would not be surprised. ;)

We have confirmed with a knowledgeable official in the Department of State Visa Office that USCIS was requesting visa numbers on Sunday July 1st, and Monday morning July 2nd - and that visa numbers were still being issued as late as the morning of July 2nd!
In fact, close to 30,000 visa numbers were requested and issued in July - through the morning of July 2nd. And we believe that many - if not most - of the requests made in the first two days of July were for applicants whose priority dates were not current in June!
So how can USCIS refuse to accept I-485 filings received BEFORE the State Department issued its notice that all visa numbers had been used???? We have not yet confirmed the return of any I-485s filed in July. But we do know that applications were reaching the USCIS before the State Department announcement - and while the USCIS was frantically working to use up the entire year's allocation.
USCIS did not use all visa numbers before July 2nd.
Did USCIS actually use the visa numbers it requested????
Historically, the USCIS doesn't request a visa number from the Department of State until it is ready to grant the adjustment of status application. US Consuls overseas request visa numbers the month before they intend to issue the immigrant visa. In fact, in making allocations of visa numbers, the Department of State factors in an expected return rate for consuls - but not for the USCIS. And the USCIS - before this June - used about 85% of the total immigrant visa numbers available.
However, already this month, the USCIS has been returning visa numbers. This confirms our earlier suspicion that the only way the USCIS could request 68,000 visa numbers in a matter of weeks was to request them in advance of adjudicating cases.
We believe USCIS exhausted the visa numbers by simply requesting them - not by using them. If so, and for reasons we will post shortly, we believe that over 30,000 visa numbers requested by USCIS will go unused - and will be wasted this year!

THere was a nice description of teh whole process in some earlier thread: they get visa numbers in chunks from DOS. They ask for them as they need them, and there is also some per-month, per-quarter rationing that goes on. Based on that they pick up and approve applications and keep using up visa numbers. They are supposed to pick up applications in order of PD, but do so in a mix of PD/RD. When they get to an applicant who is otherwise approved but they are out of visa numbers for this month, they pick the following 1st, 8th, 15th or 22nd as the cutoff date.
Dates are most likely not moving because:
- they have reassigned everyone to do receipting (as they mentioned in their FAQ)
- some dates in current VB (esp for EB3) have been pushed so far back, that they probably dont have readily approvable applications (preadjudicated)
- they are waiting for a complete tally of July VB filings to get an idea of how to move the dates

I just wanted to share this information with you all guys. I am not gaining anything by putting this in this forum. If you feel like taking it, take it else ignore it. There is no harm in sharing.
And let me say for the second time...It is always POSSIBLE that USCIS may stop accepting applications mid month...does not usually happen, but these are unusual circumstances...but this is nothing new.
As has been discussed innumerable times on this board, plan on submitting your paperwork by the 10th to be on the safer side.
By starting a new thread, and putting a sensational heading on it...you don't help anyone. It is advisable to go back and check if this issue has been discussed on some other thread

I got the similar message too and trying to find out if this is indeed an approval or not!

On August 3, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.
Not sure what ADIT and last paragraph mean... anyone with similar message..

It is obvious that DOL backlog center is processing cases with utter disregard to FIFO procedures. Some people with priority dates in 2004 or 2005 have obtained their labor certifications, but some people with priority dates in 2001 or 2002 still do not know what is happening to their cases. If we file lawsuit against DOL on their inability to maintain FIFO procedures, what are the chances of success? Their inability to maintain FIFO procedures has brought great misery in lives of the people who stood in line for so many years so patiently.
Just like the Right to Information act that was passed in India recently, the US also has the "Freedom of Information Act". I think you can ask for documentation from the agency to get information such why its taking so long for your application.

people this is such less amount, ready to pay so much money for renewing visas etc, but you can't sign up for 20 or 50 every month. This is really becoming like begging..I do understand everyone has family commitment and other financial need but $20/month is not too much !!
