Nothing new about that, he is copying news from here and there most of the time. But he provides good service to the community by keep an eye on whatever is going on.
These developments indicate the things are progressing well and we are on the right track. That's why, as a last measure, CHC had to do a press conference on the steps of the Congress to put pressure on the House Leadership/Speaker. It shows that CHC and House leadership are on opposing side of the issue and that is why CHC had to openly show this difference of opinion. It indicates that the House leadership have made a decision about moving forward the Lofgren bills. This news item indicates an excellent development.
And it appears, while CHC is putting pressure on House leadership for not doing Lofgren bills, IV is asking us all to call (and put pressure) on CHC members to support Lofgren bills. Smart move, I will call again today.

I am ROW-3, RD 06/18/07, ND 07/19/07. Received EAD cards, finger prints done for me and my family members.
This month my priority date for a family based petition became current and I do not know if it is wise to apply for GC using the family petition or not.
I understand taht I can onluy have one pending case at all times, meaning that I will withdrew the employment based petition.
If and only if, I decide to apply for GC using the family based petition, is the name check will be a problem and may take for ever?

Please help.
I am in the process of filing PERM. Ads have been placed etc and all the
formalities completed. Now, we are at a stage where the forms have to be prepared, signed and submitted. However, i am very unhappy with my attorney. He is unethical and i am afraid he will screw me up. So here are the questions
1) At this stage ( not yet filed PERM) but on the verge of filing, is it possible to change attorney or is the job order etc specific to the Attorney.
2) In form ETA -9089, in the Alien Work Experince section, it says to give the name of the aliens supervisor and the employers phone number.
MY attorney says this is not required. Any thought on this. Did your forms mention this ?
3) I am afraid my Attorney will deliberately mess up the form. What should I watch out for in the form before signing on it ?
4) IS there any redressal system at all in this country for Attorney Malpractice ? Anyone taken this route before ?

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. So there is a possibility that they will issue August Bulletin with limited date movement and act like July bulletin events never happened? Man, and we keep thinking they cannot sink any lower.
Is there a written rule that they have to request number only when they are about to approve a 485? Or is it just been a USCIS procedure. In the latter case they can change it when they want. Then they would have played everything by the rule.
1. On Jun 12 th there were lot of numbers.
2. July 2nd numbers were gone, through USCIS requests.
3. But wait a minute come July 10th some were returned(which is also legal). Now DOS may say numbers are not zero and potentially issue Aug bulletin with June dates or little movement.
4. Every new application now gets them higher fee.
And this could potentially be defense against the lawsuit. May be I am giving too much credit to USCIS but this has the makings of a great book for some official when he/she quits this administration(Like lot of others who have done this earlier).
So is it possible that the following was USCIS' plan all along in a bid to (1) force applicants to pay the higher fees and (2) reduce the number of applications they would receive. So let's try and see where USCIS or DOS acually broke the law. BTW, the following is pure speculation on my part.
1. DOS makes all categories current in the visa bulletin dated June 12.
2. This screws up USCIS's plans. So they have to force the DOS to issue a revision before July 1st.
3. USCIS frantically starts requesting visa numbers. Even for 485s with pending FBI checks.
4. Come July 2nd, USCIS still hasn't used up all the 60,000 or so numbers, but still informs DOS that all visa numbers have been exhausted.
5. DOS publishes a revised visa bulletin dated July 02 where everthing becomes unavailable.
6. USCIS acts on DOS revised visa bulletin and decides to reject all I-485s filed on July 02 and beyond.
7. July 05 onwards, USCIS starts returning the numbers to DOS. This could be for applications that have pending FBI checks.
8. DOS now decides to use some caution before issuing August bulletin. They will probably not make all categories current, but will probably shift them by a few months based on June bulletin.
9. USCIS now gets all new applications with higher fees and a reduced number of applications.
Please add to this sequence of events if you think I missed anything.
IMHO, USCIS broke the law in #4. And DOS broke the law in #5 if it was aware that visa numbers were still being issued as of July 02.

You can day trade. I have been trading for a while in various different capacities. Just make sure you have a good tax guy, they usually charge more for day traders due to all the trade reconciliation needed while doing taxes. Since I got the EAD it has become much easier though. You open a regular trading account and trade. Here is the key to day trading- Risk management, Risk management & Risk management. I cannot emphasize this enough. Most people get in with out much knowledge and burn out fast because of bad risk management. Have an exit strategy before putting on the trade and exit AT that point. Don’t get emotional.
Key thing is; I quote "Plan your trade and trade your plan".
Retail brokerage accounts like Scottrade, Ameritrade are OK for regular trading but if you want to day trade they are not good enough. Day Trading is all about execution and you will need a faster broker than these guys.
Some good ones are Interactive brokers, Think or swim (I think TD Ameritrade bought them out) and e-signal with one of their partner brokers.
For the guys in and around NY/NJ there are a lot of day trading firms like Hold Bros (Jersey City), Lynx capital and Cymera capital in NYC which offer good execution and good commissions.
Commissions have to be factored in as you will be trading a lot and all those fees add up. Execution has to be very fast <2 secs or you will loose money in slippage. Another factor with faster execution is that you might be able to front run news which gives you an advantage.
But before you jump in with both feet, do a lot of research. Paper trade a lot and hone your skills. What you know in equities is just tip of the ice berg. There are tremendous amounts of infrastructure and brains dedicated to squeezing out "alpha" and to beat them is not easy. The real money is in trading options, but this is for the really sophisticated trader. In options you can loose your entire capital.
Any one starting out must read a lot. I would suggest:
1. Come into my Trading Room- By Elder
2. The Equity Trader Course- By Schwartz
3. Trading and Exchanges: Market Microstructure for Practitioners- By Harris
For those of you a little sophisticated:
1. Volatility Trading- By Sinclair or By Johannes
2. The Options course- By Fontanills
3. Bible of Option trading- By Guy
4. Quantitative Trading- By Chan
If anyone is interested to go beyond this (one step away from insanity), let me know and I can suggest some more reading.
The key thing to realize is pattern trading is a self fulfilling prophecy. The more you trade the more you realize it.
I was under impression that being on H1b u cannot do intra day trading.. you can do only routine trading ( dont know excat term ) in which u buy stock and keep it for some time and sell it .. generally 3-4 days..

once USCIS gets a visa number from DOS for a "pre-adjudicated" app, it has to complete the approval and assign the visa number within 7 days, if not the visa number has to be returned back to DOS.

I am not following this thread regularly, but I agree with the basic logic that for EB3-I recapture is the only way out.
The data given by USCIS is just a snap shot of a particular moment like any corporate balance sheet. The figures would change (meaning go up) dynamically (& drastically) as the dates move and more people qualify to file I-485. The figure 230K+ could be much bigger considering those who have approved I-140 but cannot file 485 as the dates are not current.

We have not achieved that. Lets shoot for becoming a 8000 member community by Jan 15th. I think smaller goals are more easily achievable.

There's too much at stake to give up this campaign. Without membership, we are a weak bunch. To fight organized campaigns by groups such as Numbersusa we need the member strength.
Let us aim for 8000 members by Jan 15th. Current membership stands at 7919. We need just 80 members to reach the 8000 mark. If 10% of the current membership brings ONE member by Jan 15th, we can easily reach that target. With 300000 immigrants in this kind of quagmire, cant we get 80 people? I believe we can.

Received email this morning that my Green Card was approved - Self and Spouse.

Can you please tell me your category? Was it a EB2 or EB3? Also what was your LUD (last updated date) and 485 Receipt Date (RD)????
